Did you know that an exporter’s selection of an appropriate Incoterm® should consider protocol as well as all other responsibilities of seller and buyer? For example, in an ExWorks transaction, the seller is responsible for making the goods available to the buyer at the end of his/her loading dock, after specifying the specific place of pick-up. It is the buyer’s responsibility to take delivery of the goods at the specified place, at the appointed time. It is common as a protocol however for the seller to load the goods aboard the arriving conveyance. If in so doing, the goods are damaged, this is the responsibility of the buyer. For this reason, the ICC, in Incoterms® 2010, recommends that the Incoterm® FCA or “Free Carrier” be used for international transactions because the responsibility for loading onto a carrier and subsequent responsibility if the goods are damaged in the process of loading are clearly delineated.
